Word is that someone has claimed ownership of the parking lot in front, ripped out the fountain, and is going to build a house there.

Thank you, Hook, for posting this question!


They have torn out the palm tree and are digging to lay a foundation, with trenches, etc.  i thought they were improving the parking lot one time when I drove by because it looked like they had painted parking space lines on the dirt.


NOOOOOO, when I stopped this afternoon about 3pm to ask, the workers did indeed say they were building a HOUSE!!  I did not take the time to park the car and go inside Capt Club to talk to Malena or Mike.  Maybe tomorrow.


Who in their right mind would want to live in a house in the Captain’s Club parking lot?????  I’ve heard and seen some crazy things in this town, but today this one takes the cake!!

Unbelievable! That's the turnaround I use to get to my driveway. Not enough room to do a U-turn with my truck.

Thats whats going on. The owner of Tortillaria Superior got permits to build a house which is blocking access to the traditional turn around, knocking down the palm tree, breaking water and sewer lines. They also want to remove the Yucateco that has been protected historically located at the corner of my property on Boulivard Gabriel Estrada. On the original plat, this triangle piece of property was an área verde and it is stated in my escritura (deed).

People with power can do whatever they want in Mexico. I saw it for over 35 years. Do not know if I could be shocked anymore. Had a client that was beach front, and low and behold, someone connected politically built a house in her front yard.

CClub, don't want you to tip your hand, but what are your plans? The piece of property has been such a part of the Club, it seems it would be worth some kind of effort to retain it's availability. One other thought is the lot behind you available?

I guess that Mike could input, but I believe that he tried years ago. Pretty sure it involved that nice lady with the real estate office across the street, so count it done and move on. Not worth the fight. The guy really had to save the small cost of land vs. construction to build right there? Probably just another party house, otherwise I'd say turn up the noise and encourage them to leave.

Any idea how many square meters and how much frontage are they claiming Mike? 


If your escrtituras show a problem with their property lines, that is a problem for them.
I also wonder if they are current on all of their past property taxes?
Anyone done a Public Records search to see if they actually have a deed, or a deed that predates your paperwork signed off by public records naming the green area when you acquired your place?
Have you contributed anything to the city for the green area?

Its a cut and dry case of abuse of the system. Over the years, both, the current owner and the previous "owner" approached me wanting sell me this triangle of área verde (332.8 ms). Another person claimed it was theirs. I did not think it was a good idea to get in the middle of it. Its getting taken care of. Will keep you posted.

What is the legal significance of an area verde? Is it area that is supposed to be undeveloped, like a park or something?

Yes. Its also been an area used as access by the public. They are restricting access to public safty units like fire trucks and police etc. Actually they are trying to do alot of this ilegal construction under the cover of darkness.

You should get Vince to take some photos and ask questions....might be a good article concerning construction in San Carlos. Once it is built, they will not make them tear it down. They do stop construction on projects that are not legal....(if you get to the right people)

My goodness... there is soooo much vacant land all around San Carlos... and to build in the parking lot of a bar?

I imagine that home will be very tall to capitalize on the distant marina, bahia and sea views.
